Tenants and Swimming Pools

I recently ran across this video by Paul Dizmang of Dizmang Associates, a Realtor® and landlord in the Springfield, MO area. It reminded me of a couple of run-ins I’ve had with tenants over hot tubs and swimming pools. More than once I’ve had tenants erect above-ground swimming pools on properties they’re renting from me. I don’t specifically forbid it in the lease but what is specifically forbidden is parking cars on the grass.

Now, you would think that if parking cars on the grass is forbidden because it kills the grass, wouldn’t it be logical that erecting a structure filled with water and covering 2-3 times the area of a car would also be forbidden?

What’s even more funny is the reaction I get from the tenants when I ask them to remove the above-ground pool from the property because it KILLS THE GRASS not to mention the liability issues it creates. I get comments like, “Well what do you mean?” and “Well, it’s really hot outside….” Um… No and NO.
