Parents Negotiating On Tenant’s Behalf

So, I just read this article and it reminded me of a situation where I had to deal with the same thing.

Ass familyThe gist of the article is that a landlord signed a lease with an adult tenant who was over 18 years-old and of sound mind. A month later, the tenant’s father decided that he did not like the space his daughter (the tenant) leased and called the landlord to “rescind the lease.”

One of my ex-tenants decided that she could not deal with the big, bad landlord (I’m not bad or that big) and had her mother call me to complain about something or other that was an issue at the time.

I promptly informed the tenant’s mother that her name was no where on the lease and I that I wasn’t sure why we were having this conversation. The tenant’s mother let me know that her daughter was a bit of a “hot head” and didn’t know who to call about the issue at hand.

I let the mother know that if there were any problems with anything to do with the property, that the tenant should call me herself and we would discuss it. The mother then let me know that she would call her attorney if I would not talk to her.

Now, in my experience, when someone says, “I’m going to call my attorney” typically they don’t have an attorney. If someone is going to sue you, they just serve the papers and that starts the suit not the threat of “I’m going to call my attorney.”

As an end note, this tenant ended up being evicted mostly because she had a problem calling me on the phone when she couldn’t pay the rent. I had no choice but to file for eviction.
